Moving Violations

What is a "Moving Violation" and why does it matter? 

A moving violation is defined by WAC 308-104-160. The definition includes violations such as speeding, failure to yield, improper passing, HOV lane violations and many, many more. Our expert legal team at 1st Hand Law identifies and fights against moving violations on a daily basis. We understand the legal elements required to establish a case against a driver accused of any violation. 


Why Does a Moving Violation Matter?

A moving violation versus a non-moving violation is an important distinction for several reasons. First, drivers who are cited with a moving violation and found to have committed the moving violation will likely have that violation reported to their car insurance company and could see an increase in their insurance premiums. Additionally, Washington State law RCW 46.20.2892, commonly referred to as the "Cumulative Ticket" statute which establishes a requirement for the Washington State Department of Licensing to suspend an individual's driver's license if they are found to have "committed" 3 or more moving violations within 12 months or who have "committed 4 or more moving violations within 24 months. What can I do if I have received a suspension letter form the DOL?

1st Hand Law assists many Washington State Drivers who were unaware of the new cumulative ticket statute. Just because you have received a letter from the Department of Licensing stating that they will suspend your license, that does not prevent our legal team at 1st Hand Law from helping you. 


1st Hand Law can not only assist you with a new ticket that triggered a warning letter indicating a potential future suspension of your license, but we can also help you with potentially re-opening and fighting previous tickets that caused a suspension action to begin. Our legal team can submit filings to the court requesting to re-open closed tickets that you have previously paid off or otherwise found committed. While we cannot guarantee that the court will grant our motion to re-open your past tickets, we can and will fight for you. 

What happens if I just pay my fine?

If you decide to simply pay the fine associated with your infraction, the Court will enter a default judgement of "committed" and will process your payment to satisfy the amount owed. This judgement will be recorded on your driving record, and if the underlying violation is a moving violation, is accessible to insurance companies, and counts as a moving violation towards the "Cumulative Ticket" statute. 


Allowing 1st Hand Law to fight your infraction and obtaining a judgment of dismissed, not committed, or an amendment to a non-moving violation keeps your driving record clean for insurance purposes and keeps the Department of Licensing from taking action against you for that infraction.

What if this is my first ticket and I am not at risk of losing my license?

Just because you do not have previous offenses does not mean that you should'nt fight your ticket. Insurance companies are extremely diligent when evaluating the driving record of their insured, especially when it is time to renew a policy. Insurance companies have access to your driving record and can see any and all moving violations that have been found committed. These can very likely cause an increase in your insurance premium.

New legislation that all Washington Drivers should be aware of

On May 12, 2025 the Washington State Governor signed House Bill 1596 into law, this law will go into effect no later than January 1, 2029. House Bill 1596 is commonly referred to as "The BEAM Act". This law will require certain Washington State drivers to install "Intelligent Speed Assistance" devices on their vehicles in order to continue driving. These devices will use GPS location technology to identify the speed limit in which the vehicle is located and prevent the vehicle from exceeding the posted speed limit.
